A Wasiat is an Islamic will. You can give up to one third of your estate to people or causes that don't inherit under Faraid, such as a mosque, a waqf, an adopted child or non Muslim family. The rest goes to your heirs under Faraid. A Wasiat also lets you appoint your own executor.

Faraid is the Islamic law of inheritance. It sets fixed shares for family members, based on the Quran.

• A wife receives 1/8 if her husband leaves children, or 1/4 if there are none.
• A husband receives 1/4 if his wife leaves children, or 1/2 if there are none.
• A son generally receives twice the share of a daughter.

In Singapore, Faraid is provided for under the Administration of Muslim Law Act and administered through the Syariah Court, which issues an Inheritance Certificate setting out each heir's share.

Faraid only settles the shares. It doesn't name who manages your estate, give anything to people outside the heirs, or tell your family what you own. A Wasiat does all three.

The whole estate is distributed according to Faraid. Your family applies to the Syariah Court for an Inheritance Certificate and to the Family Justice Courts for a Grant of Letters of Administration. You don't get to choose who manages the estate, and nothing can go to charity or loved ones outside the heirs.

A normal will lets you leave your assets to anyone, in any share. An Islamic will has to follow Faraid. You can give away up to one third, to people who aren't already heirs unless the other heirs agree. The rest goes in fixed shares.

Yes. You must be at least 21 and of sound mind. The will must be in writing and signed in front of two witnesses present at the same time, who also sign. Witnesses and their spouses shouldn't be beneficiaries. For Muslims, the will must also follow Faraid. Small mistakes can invalidate a will, which is why many families use an Islamic estate planner.

List your Faraid heirs, assets and debts. Decide who receives up to one third. Choose your executor. Draft the will so it follows Faraid and Singapore law. Sign it in front of two witnesses who aren't beneficiaries. Store it safely and tell your executor where it is. Then check your CPF and insurance nominations, because your will doesn't cover them.
